These Terms of Service (“Terms”) govern your access to and use of the RMIT Sailing Club website located at www.rmitsailing.club(the “Site”) and any related services provided by the RMIT Sailing Club (“Club”, “we”, “us”, or “our”). By accessing or using the Site, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, registering for events, or otherwise using the Site, you confirm that you are at least 18 years of age (or have parental/guardian consent), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, please do not use the Site.

2. Membership & Accounts

Membership of the RMIT Sailing Club is administered through this Site. When registering:

  • You must provide accurate, current, and complete information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorised use of your account.
  • You may not share your account with others or use another member's account.
  • We reserve the right to suspend or terminate accounts that breach these Terms.

3. Event Registration & Participation

When registering for Club events:

  • You agree to abide by all Club rules and the instructions of Club officers and event coordinators.
  • You acknowledge that sailing and water-based activities carry inherent risks.
  • You confirm that any medical information you provide (including emergency contact details) is accurate.
  • Cancellations must be made in accordance with the specific event's cancellation policy communicated at time of registration.
  • The Club reserves the right to cancel or modify events due to weather, safety, or other unforeseen circumstances.

4. Acceptable Use

You agree not to use the Site to:

  • Submit false, misleading, or fraudulent information.
  • Impersonate any person or entity.
  • Attempt to gain unauthorised access to any portion of the Site or its related systems.
  • Transmit any malicious code, spam, or unsolicited communications.
  • Engage in any activity that disrupts or interferes with the Site's operation.
  • Harvest or collect personal information about other members without their consent.
  • Violate any applicable law or regulation.

5. Personal Data & Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect and process personal data — including emergency contact details and medical notes — solely to administer your membership and ensure safety at Club events. We do not sell your data to third parties. Data is hosted securely via Supabase and email communications are managed via Resend.

6. Intellectual Property

All content on the Site, including text, images, logos, and design elements, is the property of the RMIT Sailing Club or its content licensors. You may not reproduce, distribute, or create derivative works from any content on the Site without our express written permission.

7. Disclaimer of Warranties

The Site and its content are provided “as is” without warranty of any kind. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, the RMIT Sailing Club, its officers, members, and volunteers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or participation in Club activities. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

9. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

10. Changes to These Terms

We may update these Terms from time to time. We will notify members of material changes via email or a prominent notice on the Site. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
